§ 1

Preliminary provisions

  1. The Card online store at www.thecard.pl, is run and owned by Finite State Solutions, a sole proprietorship of Remigiusz Marcinkiewicz. Company is registered in Central Registration and Information on Economic Activity (CEIDG), registry run by the Ministry of Economic Development of the Republic of Poland. Company’s identification numbers: VAT ID PL8992647802, REGON 382 506 195

  2. Regulations apply to everyone using the store.

  3. We reserve the right to update, change or replace any part of these Terms and Conditions by posting changes to The Card website.

  4. The Terms and Conditions are governed by Polish Law.

§ 2

Terms

  1. Customer – a person purchasing goods in the Store, either a natural person or a company.

  2. Seller – a natural person who has legal capacity and pursues economic activity as Finite State Solutions Remigiusz Marcinkiewicz

  3. Consumer - a natural person who makes a contract with the Seller by purchasing goods in the Store with intent of personal use.

  4. Store – online store run by Seller at www.thecard.pl

  5. A Sale Contract - a contract concluded between the Seller and a Customer using the Store without simultaneous physical presence of the Seller and the Customer, with the exclusive use of one or more means of distance communication up to and including the time at which the contract is concluded with the intent of exchange of goods.

  6. Terms and Conditions – this document.

  7. Order - statement of Customer’s will submitted through the Store’s order form with intention of concluding a distance sale contract between Client and Seller.

  8. Account – Customer’s account in the store. Account is used to store Customer’s details and history of Customer’s orders.

  9. Registration form – a form needed to create an account in the Store.

  10. Order Form – interactive form used in the Store to place an order. An Order Form is used by the Customer to confirm terms of his contract with the Seller by choosing Products, shipping method and payment method.

  11. Product - an item available in the Store which may become a subject of the sale contract between Customer and Seller.

§ 4

General

  1. Seller isn’t responsible for outages of the Store caused by unauthorised act of a third party or force majeure.

  2. Product prices are given in Polish zloty (PLN).

  3. The Store can display product prices in other currencies based on current average currency exchange rate.

  4. The final price is a total of chosen Products’ prices and shipping costs. Total price is displayed for Customer who agrees on it by placing an Order.

  5. Seller made every effort to provide accurate images of Products in the Store. Nevertheless, Seller cannot guarantee that Customer’s computer monitor's display of any color will be accurate.

  6. Customer agrees to provide current, complete and accurate purchase and account information for all purchases made at the Store. Customer agrees to bear the cost of missed or returned delivery and another shipping attempt that result from providing inaccurate information.

  7. Sale contract is concluded after the Seller acknowledges a Customer's order.

  8. Order preparation and handling may take up to three business days after the payment is confirmed.

  9. The payment has to be completed by the Customer within 10 days after placing an Order. If required, additional time may be requested by customer for international orders.

  10. Delivery time provided by the store is approximate and based on the estimates provided by the shipping operator. Seller is not responsible for a delay caused by the shipping operator.

§ 5

Creating an account in the Store

  1. To create an account in the Store, a Customer fills out the Registration Form. The following data is required for registration: name, surname, shipping address, email address, phone number.

  2. Account creation and removal are free of charge.

  3. A Customer needs a login and a password to log into the Account. Customer should never, under any circumstances, reveal their password to a third party.

§ 6

Payment and shipment

  1. Customer may select shipment or pick up in Store.

    2. Shipment details are available at the Store site.

    3. All shipments are registered.

  2. Orders are shipped worldwide with exception of the following countries:

    1. Syria

    2. Indonesia

    3. Somalia

    4. Philippines

    5. Nigeria

    6. Malaysia

Order in which the shipping address is located in any of the above countries will be cancelled.

  1. Customer can pay through PayPal, Przelewy24 or a regular bank transfer.

§ 7

Customer's right to cancel a Sale Contract

  1. A Customer, who is a Consumer, has a right to cancel a distance Sale Contract for any reason within 14 days of receiving the shipment.

  2. For an Order cancellation to be valid the Customer must ship the Order back to the Seller within 7 days of cancellation.

  3. A Customer may inform Seller about cancellation via email or a written statement sent within the return shipment.

  4. Consequences of cancellation :

    1. Cancelled Sale Contract is perceived as if it never existed.

    2. Seller returns the payment (product and shipment costs) to Customer within 14 days from receiving a return shipment.

    3. The refund is issued through the method of payment used by the Customer in the order.

    4. Seller does not refund the cost of return shipment.

    5. Customer is responsible for loss of value of the Product resulting from use or from improper packaging of the return shipment.

§ 8

Complaints and warranty

  1. Seller is obligated to deliver a Product in new and unused condition, without any defects.

  2. Should any defect manifest in the product, the Customer has a right to refund or replacement as defined by the applicable laws. In case of replacement, the Seller bears the cost of shipping.

  3. Complaint should be submitted in writing, by mail or email.

  4. Rightful complaint shall contain short description of the defect, date of when the defect was noticed, contact details of Customer and chosen way of conduct (refund or replacement).

  5. Seller will reply to a complaint within 14 days from receiving it. Lack of response within this tame means the complaint is accepted.

  6. Customer has the right to resolve disputes with seller out-of-court. To use this right, a Consumer should make a complaint at http://ec.europa.eu/consumers/odr/
